0);">“帮信罪”在设立之初一直很“安静”。裁判文书网的数据显示，2019年之前，“帮信罪”文书不足百份，2019年有所增多，达到百份。“但之后，本罪适用迅速扩大，2021年全国检察机关共起诉涉嫌帮信罪犯罪嫌疑人12.93万人，同比上升8.43倍。”浙江省公共政策研究院研究员高艳东告诉记者。</span></section><section style="line-height: 1.75em;"><br></section><section style="line-height: 1.75em;"><span style="font-size: 16px;color: rgb(0, 0, 0);">随之的一个问题是：为何2020年作为一个“帮信罪”节点，数量陡增，并在2021年达到高峰？</span></section><section 0);">2019年10月最高检、最高法发布了《关于办理非法利用信息网络、帮助信息网络犯罪活动等刑事案件适用法律若干问题的解释》（下称“解释一”）。</span></section><p style="line-height: 1.6em;"><br></p><section mp-original-font-size="16" 0);">在“解释一”发布之前，刑法关于“帮信罪”的表述较为模糊。表现为既不好确定“明知”的情形，也无法明确何为“情节严重”，而这两者是确认“帮信罪”的要件。“解释一”列出了“帮信罪”中“明知”和“情节严重”的7种情形，给公安机关和司法机关的办案审判提供了具体的指导，从而使得效率提高。</span></section><section style="line-height: 0);">高艳东表示，“解释一”的出台是导致“帮信罪”爆发的其中一个原因。此外，当前网络犯罪本身呈现的高发态势，导致相应帮助行为数量庞大。</span></section><section style="line-height: 1.75em;"><br></section><section style="line-height: 1.75em;"><span style="font-size: 16px;color: rgb(0, 0, 0);">而且，“帮信罪”帮助手段较为集中，多表现为帮助上游诈骗团伙“跑分”洗钱、为诈骗团伙提供收发短信验证码“服务”、为诈骗团伙非法获取并提供批量社交媒体账号等行为，由此催生了大量从业群体。</span></section><section style="line-height: 1.75em;"><br></section><section 1.75em;"><br></section><section style="line-height: 1.75em;"><span style="font-size: 16px;">而还有一个不怎么被关注，但现实的原因是——“帮信人员”是整个电信诈骗链条中最容易到案的人员。</span></section><section style="line-height: 16px;">上述深圳反诈民警告诉记者，电信诈骗中，处于上游的诈骗分子多盘踞在境外，如东南亚、中东等地。“像缅甸的瓦邦、果敢那些地方，它原来就是金三角那一块区域，是专门贩毒制毒的区域。”这导致电诈中最危险的诈骗人员常常无法抓获。同时，帮信人员大都在境内，而且其身份通过银行卡可以快速查询锁定，很容易到案。</span></section><section style="line-height: 16px;">但这并非是因为抓不到电诈的主犯而抓这些帮信人员顶罪。上述反诈民警跟记者强调，帮信行为在整个电诈过程中起着关键作用。“这些人想要骗钱，总要有两个东西，一个是交流的工具，另一个就是收钱的工具，最重要的是收钱的工具。”</span></section><section style="line-height: 1.75em;"><br></section><section
